Florida workers' comp thresholds depend on the type of business.

The Florida Division of Workers' Compensation uses different coverage thresholds for construction, non-construction, and agricultural employers. This guide helps owners ask better questions before a quote review.

Construction

One employee can trigger coverage.

Florida DFS says construction employers with one or more employees, including some corporate officers or LLC members, must have workers' compensation coverage unless a valid exemption or other rule applies.

Non-construction

The common threshold is four.

Non-construction employers generally need workers' compensation coverage when they have four or more employees, including some owners who count as employees.

Agriculture

Agriculture has separate rules.

Florida DFS lists coverage thresholds for agricultural employers based on regular and seasonal worker counts. This should be reviewed separately from construction and general business rules.

Do not use employee count alone as the final answer.
